Skuadz Skuadz To use this website and/or this application, it is necessary to have read and accepted the following terms of use.
1.1 These terms of use regulate the use of services and content that Skuadz provides and makes available to users in its Skuadz app application (hereinafter, the "App").
1.2 These terms of use are applicable to natural persons over 14 years of age, or legal entities, who access the App content (section 3 below includes a definition of the term "Content") and/or use the services provided in the App (hereinafter, the "User(s)"). Minors under 14 years of age must have the consent of their parents or legal guardians to use the App.
1.3 The mere use of the App by the User implies full acceptance of these terms of use. If a User cannot accept any of these terms of use for any reason, they must refrain from using the App. The use of certain services offered to Users in the App is regulated by particular conditions that will apply together with these terms of use. The User must read and accept those particular conditions when they intend to access such services. In case of conflict between these terms of use and particular conditions, the particular conditions will prevail.
1.4 The terms of use and particular conditions may be modified by Skuadz at any time.
1.5 The use of the App requires an Internet connection. The availability and quality of Internet access may vary depending on various factors such as available bandwidth, the type of device used, or the User's geographic location. These factors do not depend on Skuadz and it is not responsible for any aspect related to the User's Internet access service. The App is available for smartphones with Android OS and Apple iOS operating systems.
The services and Content offered by Skuadz in the App are, in principle, and unless otherwise indicated, free of charge.
The User agrees to use the Content and services available in the App in accordance with these terms of use and with the particular conditions established for certain services, as well as in accordance with applicable legislation, morals, and good customs.
The User will refrain from using the App for any type of commercial or business activity, unless Skuadz has previously authorized such use in writing.
In the context of their use of the App, the User will refrain from uploading, sending by email, or communicating in any way, content and material that infringe third-party rights, that are contrary to morals and good customs, that are in any way illegal, or that contain computer viruses or any type of computer code, files, or programs that may interrupt, limit, or interfere with the functionality of any software, hardware, or telecommunications devices, including the App.
Skuadz does not guarantee the availability and continuity of the operation of the App, its services, and its Content, so it will in no case be responsible for damages of any nature that may be due to the lack of availability or continuity of the App, or for failures in access to the different sections of the App.
Skuadz does not guarantee the usefulness of the App for any particular activity or the suitability of its Content and services for specific purposes, so the use of information, Content, and services is carried out under the sole and exclusive responsibility of the User. The Content included in the App is provided in good faith by Skuadz with information from both internal and external sources. Skuadz cannot guarantee the reliability, accuracy, and timeliness of the information made available to the User, despite its best efforts to provide accurate and up-to-date information. Skuadz will not be responsible, in any case, for any content, information, communication, opinion, or statement of any kind that is communicated, disseminated, transmitted, or displayed through the app from external sources, including the User.
Skuadz cannot control the use of the App, and its services and Content, by Users and therefore will not be responsible for damages of any nature, including computer damage, that may be due to illegal, incorrect, inappropriate, or inadequate use by Users of the App, and its services or Content. Likewise, to the maximum extent possible under applicable law, Skuadz will not be responsible for computer or other damages that access to Content and/or provision of services in the App may cause to the User.
Skuadz excludes, to the extent permitted by law, any liability for damages of any nature arising from:
a) The impossibility of accessing the mobile application or the lack of truthfulness, accuracy, completeness, and/or timeliness of the content, as well as the existence of defects of any kind in the content transmitted, disseminated, stored, made available through the website and/or mobile application or the services offered.
b) The presence of viruses or other elements in the content that may cause alterations in computer systems, electronic documents, or user data.
c) Non-compliance with laws, good faith, public order, trade uses, and this legal notice as a result of incorrect use of the app. In particular, and by way of example, Skuadz is not responsible for the actions of third parties that violate intellectual and industrial property rights, trade secrets, rights to honor, personal and family privacy, and self-image, as well as regulations on unfair competition and illegal advertising. Likewise, Skuadz declines any responsibility for information outside this app and not directly managed by our administrator.
All content, understood as, without limitation, texts, photographs, illustrations, graphics, software, databases, designs, graphics, source and object code, audiovisual and sound content, as well as names, logos, domain names, trademarks, and other distinctive signs accessible in the App (hereinafter, the "Content") are subject to industrial and intellectual property rights owned by Skuadz, or by third parties who have licensed their use to Skuadz. Likewise, the rights to the structure and computer code of the App belong to Skuadz as owner or licensee. Access by the User to the Content and services of the App does not imply, in any case, any type of waiver, transmission, or total or partial assignment of the aforementioned rights, nor does it confer any right of use, alteration, exploitation, reproduction, distribution, public communication, or decompilation of the Content subject to intellectual or industrial property. The User enjoys a non-exclusive license to use the App limited to accessing the Content for the purpose of enjoying the services provided in the App. The license is granted to the User for personal use of the App and Content, without being able to make any kind of use for commercial or business purposes.
The User grants Skuadz a non-exclusive license over the materials or content that the User communicates to Skuadz or that they disclose or disseminate using the App. Said license includes all property rights over the materials or content created by or owned by the User and is agreed for the entire duration thereof and for all countries of the world.
Skuadz maintains a policy of strict respect for the industrial and intellectual property rights of third parties. Therefore, the sending or inclusion in the App of content that may infringe such rights is strictly prohibited. However, despite Skuadz's efforts, it is possible that occasionally some User may insert content of this type. In the event that any User or third party considers that there are facts or circumstances revealing the illegal nature of the use of any content and/or the performance of any activity in the App, and, in particular, the violation of industrial or intellectual property rights or other rights, they must send Skuadz a notification as indicated in the following section containing the following information:
a) Personal data of the claimant: name, surnames, and email address;
b) Description of the alleged illegal activity carried out in the App and, in particular, when it involves an alleged violation of rights, precise and specific indication of the protected content, as well as its location in the App;
c) Evidence and facts indicating the illegal nature of such activity, including proof of the claimant's rights;
d) Express statement that the information provided in the notification is accurate and that the use of the content or the performance of the activities described is illegal.
Without prejudice to the provisions of the law, all notifications and communications made by the User to Skuadz must be made by email to the following address: support@skuadz.com
Skuadz may withdraw or suspend the provision of services at any time and without prior notice to those Users who breach the provisions of these terms of use or the particular conditions of a specific service.
Skuadz commits not to allow any transaction that is illegal, or is considered by credit card brands or the acquiring bank, that may or has the potential to damage the goodwill of these or negatively influence them. The following activities are prohibited under credit card brand programs: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Buyer, Issuing Bank, Merchant, Cardholder, or cards.
